Laura Walker has over 30 years of legal experience. She has been a partner with Cable Huston since 1990. From 1998 to 2000, she spent two years in Hong Kong and rejoined the firm upon her return.
Ms. Walker represents secured and unsecured creditors in various proceedings before the Bankruptcy Court. She has handled objections to claims, confirmation hearings, preference claims, discharge litigation, and contested cases. Ms. Walker represented the debtor in the first Chapter 11 reorganization filed in Oregon after the adoption of BAPCA. Ms. Walker has also represented creditors committees in several reorganization cases.
Ms. Walker also assists clients with all types of collection issues, including construction lien claims, the enforcement of indemnity agreements for surety bonds, the collection of unsecured debts, the foreclosure of trust deeds and mortgages, and the enforcement of contracts for the sale of businesses. Ms. Walker’s business and commercial litigation practice encompasses fidelity insurance claims, construction disputes, breach of contract claims, and real estate matters.
Finally, businesses look to Ms. Walker for advice on restructuring loans and negotiating agreements with creditors. She has negotiated forbearance agreements on behalf of lenders and debtors and supervised out-of-court workouts and business liquidations.
Recent Representative Matters
Represented scrap metal processing firm in Eugene, Oregon in Chapter 11 reorganization. In re Pacific Recycling, Inc., Case No. 15-62925fra11. A plan of reorganization was confirmed in January of 2017 to restructure approximately $8 million in secured debt and $6 million in unsecured debt.
Represented unsecured creditors committee in the Chapter 11 bankruptcy proceedings for an Oregon non-profit corporation, DePaul Industries, Inc. and negotiated an increase in the distribution for unsecured creditors, April 2017.
Represented several mortgage lenders regarding real estate loans to Sunwest Management, Inc. and related entities in connection with bankruptcy proceedings for the Sunwest unitary enterprise, the Jon Harder bankruptcy and the SEC receivership in U.S. District Court. Also acted as local counsel in related state court litigation.
Lead trial counsel in action to quiet title to coastal property adjacent to the Nehalem River jetty in Tillamook County. Won court order quieting title to the land for client following two-week bench trial. Successfully defended against appeal of the trial court judgment before the Oregon Court of Appeals. Sea River Properties, LLC v. Parks, 253 OR 643, 297 P3d 1212(2012).
Lead trial counsel for plaintiff in a six week jury trial in Multnomah County relating to multi-million dollar oral loan agreement between an individual and local art gallery. Settlement agreement negotiated following favorable jury verdict.
Represented secured creditor on motion to dismiss a partnership bankruptcy. Dismissal was based on failure to obtain consent of all partners prior to filing the bankruptcy petition. In re Loverin Ranch (Bankr. D. Or. June 2013). Read More
Mediation and Arbitration
Ms. Walker is committed to providing legal services in an efficient manner by employing mediation or other alternatives to litigation when appropriate. She serves as an arbitrator on behalf of the Arbitration Service of Portland and in the Circuit Court’s mandatory arbitration program.
